This document constitutes a legally binding agreement between you and FriendsFort, Inc.
Please read it carefully before using the platform.

    sports broadcasts without a valid license. FriendsFort uses automated Content
    ID technology.
  • Disclosure: Paid partnerships and sponsored content must always be
    labeled with #Ad, #Sponsored, or #Paid per FTC guidelines.
  • Disputes (U.S.): Disputes are resolved through binding individual
    arbitration — not class action lawsuits.
  • Governing Law: These Terms are governed by the laws of the State of
    Delaware, United States.

    Welcome to FriendsFort, a social media platform operated by FriendsFort, Inc.
    (“FriendsFort,” “we,” “us,” or “our”). FriendsFort enables people around the world
    to connect, communicate, and share experiences through posts, videos, audio,
    photographs, messaging, live streams, groups, events, and other interactive
    features.
    These Terms and Conditions (the “Terms”) constitute a legally binding agreement
    between you (“User,” “you,” or “your”) and FriendsFort, Inc. governing your access
    to and use of the FriendsFort platform, including all websites, mobile applications,
    APIs, and related services (collectively, the “Platform”).
    By creating a FriendsFort account, accessing the Platform, or otherwise
    using any part of FriendsFort’s services, you acknowledge that you have
    read, understood, and agree to be legally bound by these Terms in their
    entirety. If you do not agree to these Terms, you must not access or use the
    Platform.
    These Terms apply to all users of the Platform, including but not limited to:
    registered members, casual visitors, business account holders, creator accounts,
    and third-party developers accessing FriendsFort via API.
    These Terms should be read alongside our Privacy Policy, which describes how
    we collect, use, and protect your personal information, and any supplemental
    policies referenced herein (including the Advertising Policy, Creator Terms, and
    Developer Agreement). In the event of any conflict between these Terms and a
    supplemental policy, the supplemental policy shall govern with respect to the
    specific subject matter it addresses.
  20. Eligibility and Account Registration
    2.1 Age Requirements
    FriendsFort is intended for users who are at least 13 years of age. Users in the
    European Union or European Economic Area (“EU/EEA”) must be at least 16 years
    of age to use the Platform, in compliance with the General Data Protection
    Regulation (GDPR). Users between the ages of 13 and 17 (or the applicable age of
    digital consent in their jurisdiction) must obtain verifiable parental or legal
    guardian consent prior to creating an account or using the Platform.
    FriendsFort reserves the right to require age verification at any time and to
    terminate or restrict access to any account that FriendsFort reasonably believes is
    held by an individual who does not meet the applicable minimum age requirement.
    Provision of false age information is a material breach of these Terms.
    2.2 Account Creation
    To access the full features of FriendsFort, you must register for an account. By
    registering, you agree to:
    ● Provide accurate, current, and complete information during the registration
    process and keep such information up to date at all times;
    ● Maintain only one personal account. Duplicate accounts, fake accounts, and
    accounts created to circumvent prior enforcement actions are strictly
    prohibited;
    ● Maintain the confidentiality and security of your login credentials, including
    your password. You are solely responsible for all activity that occurs under
    your account;
    ● Notify FriendsFort immediately of any unauthorized use of your account or
    any other breach of security by contacting security@friendsfort.com; and
    ● Not share your account credentials with any other person or allow any third
    party to access your account.
    FriendsFort cannot and will not be liable for any loss or damage arising from your
    failure to comply with the above account security obligations. Business accounts,
    brand accounts, and creator accounts may be subject to additional terms and
    policies as outlined in the applicable supplemental agreements.
    2.3 Account Types
    FriendsFort offers the following account types, each with distinct permissions,

    under a personal account classification is a violation of these Terms.
  21. Platform Usage and Acceptable Use Policy
    3.1 Permitted Uses
    Subject to your compliance with these Terms, FriendsFort grants you a limited,
    non-exclusive, non-transferable, revocable right to use the Platform for the
    following lawful purposes:
    ● Sharing original personal content, including posts, photographs, videos,
    audio clips, and stories;
    ● Connecting and communicating with friends, family members, and
    communities;
    ● Discovering content, following other users and creators, and engaging with
    the broader FriendsFort community;
    ● Using FriendsFort’s built-in features, including direct messaging, groups,
    events, live streaming, and the FriendsFort Marketplace;
    ● Promoting a legitimate business or personal brand within the boundaries of
    FriendsFort’s Advertising Policy and these Terms.
    3.2 General Usage Rules
    All users agree to use the Platform in a lawful, respectful, and good-faith manner.
    The following conduct is expressly prohibited:
    ● Using automated bots, scrapers, crawlers, or scripts to access or collect data
    from FriendsFort without prior written permission;
    ● Impersonating any person, brand, organization, public figure, or FriendsFort
    employee;
    ● Engaging in spam, including mass messaging, repetitive posting, fake
    engagement (purchased likes, followers, or comments), or coordinated
    inauthentic behavior;
    ● Attempting to access areas of the Platform beyond your authorized
    permission level or circumventing access controls;
    ● Collecting, harvesting, or aggregating personal data of other users without
    their explicit consent;
    ● Engaging in commercial solicitation, sales, or promotions outside
    FriendsFort’s designated Marketplace areas;
    ● Interfering with or disrupting the Platform’s servers, networks,
    infrastructure, or security systems;
    ● Accessing FriendsFort through unauthorized third-party applications or
    clients not approved by FriendsFort.
    3.3 Usage Limits
    FriendsFort reserves the right to impose reasonable usage rate limits on any
    account or API consumer to protect the integrity, performance, and security of the
    Platform. Accounts found to be abusing Platform features — including excessive
    posting, message flooding, or API overuse — may face temporary or permanent
    feature restrictions without prior notice. API access is subject to the separate
    FriendsFort Developer Agreement and applicable rate limits described therein.
  22. User-Generated Content
    4.1 Content Ownership
    You retain full ownership of all original content you create and post on FriendsFort
    (“User Content”). FriendsFort does not claim ownership of your content.
    However, by posting, uploading, sharing, or transmitting User Content on or
    through the Platform, you grant FriendsFort, Inc. a non-exclusive, royalty-free,
    worldwide, sublicensable, and transferable license to: host, store, cache,
    display, reproduce, modify (for formatting and technical compatibility purposes
    only), distribute, transmit, and promote such content across FriendsFort’s services
    and authorized partner platforms.
    This license exists solely to enable FriendsFort to operate, maintain, improve, and
    promote the Platform and is automatically revoked when you delete the applicable
    content from the Platform, subject to retention timelines described in our Privacy
    Policy and any applicable legal obligations.
    4.2 Content Responsibility
    You are solely responsible for all content you post, share, upload, or transmit
    through FriendsFort. FriendsFort does not endorse, verify, or assume any liability
    for User Content. By posting content, you represent and warrant that:
    ● You own the content or have obtained all necessary rights, licenses, and
    permissions to post it;
    ● The content does not violate any third-party intellectual property rights,
    privacy rights, publicity rights, or contractual rights;
    ● The content complies with all applicable local, state, national, and
    international laws and regulations;
    ● The content does not violate these Terms or any FriendsFort supplemental
    policy.
    You agree to indemnify and hold harmless FriendsFort, Inc. from any and all
    claims, damages, liabilities, or expenses arising out of or related to your User
    Content.
    4.3 Content Standards
    All content posted on FriendsFort must meet the following minimum standards.
    Content must:
    ● Be lawful and compliant with all applicable local, state, national, and
    international laws;
    ● Not infringe any copyright, trademark, trade secret, patent, or other
    intellectual property right;
    ● Not include personal information of other individuals without their explicit,
    informed consent;
    ● Not be deceptive, fraudulent, misleading, or designed to manipulate other
    users;
    ● Not promote, facilitate, or assist in any illegal activity or harm to any
    person.
  23. Copyright and Intellectual Property Policy
    5.1 Copyright Ownership — FriendsFort Platform
    FriendsFort, Inc. owns all intellectual property rights in and to the Platform itself,
    including without limitation its name, logo, brand identity, interface design,
    software architecture, algorithms, source code, and all original content created by
    or for FriendsFort. These rights are protected under U.S. and international
    copyright, trademark, patent, and trade secret law. Users may not copy,
    reproduce, modify, distribute, reverse-engineer, or create derivative works from
    FriendsFort’s proprietary materials without express prior written permission from
    FriendsFort, Inc.
    5.2 User Content and Copyright Requirements
    You must own the copyright in, or have obtained explicit written permission from
    the copyright holder for, ALL content you upload to FriendsFort. This
    requirement applies to, but is not limited to:
    ● Videos — including full-length recordings, short clips, and excerpts;
    ● Music, songs, and audio recordings — including brief clips used as
    background music;
    ● Photographs, images, and digital artwork;
    ● Written works, articles, poetry, and literary content;
    ● Film clips, television excerpts, and broadcast recordings;
    ● Podcast recordings and radio broadcasts;
    ● Live-streamed performances featuring third-party music or media;
    ● Artwork, graphics, and illustrations created by third parties.

    ● Copyrighted songs or sound recordings without a valid synchronization and
    master use license;
    ● Background music from commercially released albums, streaming services,
    radio, or broadcast media;
    ● Remixes, covers, or mashups of copyrighted songs, unless the user holds the
    appropriate mechanical and synchronization licenses;
    ● Audio samples lifted from commercial recordings;
    ● Voiceovers reading copyrighted scripts, books, published articles, or other
    protected literary works;
    ● Any other copyrighted audio material for which the user does not hold a
    valid license.
    FriendsFort uses automated Content ID technology to scan uploaded content
    for unlicensed music and audio. Upon detection of unlicensed audio, FriendsFort
    may, at its discretion: (a) mute the audio track; (b) remove the content entirely; or
    (c) redirect any monetization associated with the content to the rights holder.
    Users will be notified of any such action.
    FriendsFort Licensed Music Library: FriendsFort provides a royalty-free music
    library that all users may access and use freely within the Platform. Use of
    unlicensed music or audio outside of this library is a violation of these Terms and
    will result in enforcement action.
    5.4 Video and Film Rules

    Critical — Video and Film Copyright
    Posting unlicensed video content — including clips from films, TV shows,
    sports events, or music videos — constitutes copyright infringement and may
    result in content removal, DMCA strikes, and account termination.
    Users must NOT upload any of the following:
    ● Full or partial episodes of television shows, films, movies, or streaming
    content;
    ● Sports broadcasts, live events, or pay-per-view content;
    ● Music videos from commercial artists without the express authorization of
    the record label or artist;
    ● Content recorded in movie theaters (i.e., “cam recordings”);
    ● News broadcast clips exceeding 15 seconds without substantial
    transformative commentary that qualifies as fair use;
    ● Video game stream content that violates the applicable game developer’s
    streaming or content creator policy.
    Reaction Videos: Reaction videos may incorporate brief clips from third-party
    works only where such use constitutes genuine commentary, criticism, or
    educational use (fair use principles apply). The original work must be substantially
    transformed. Merely watching and reacting to another’s content without
    meaningful transformation does not qualify as fair use.
    Live Streams: Users broadcasting live content are solely responsible for ensuring
    that any music, media, or third-party content appearing or playing during the live
    stream is properly licensed or royalty-free. FriendsFort may terminate a live
    stream in real time if unlicensed content is detected.
    5.5 DMCA — Digital Millennium Copyright Act Compliance
    FriendsFort complies fully with the Digital Millennium Copyright Act (17 U.S.C. §
    512) and maintains safe harbor protections by promptly responding to valid
    takedown notices.
    How to File a DMCA Takedown Notice: Copyright owners who believe their
    work has been infringed on FriendsFort may submit a written notice to
    FriendsFort’s Designated Copyright Agent. To be valid, the notice must include:
    ● (a) A description of the copyrighted work claimed to have been infringed;
    ● (b) Identification of the infringing content and its URL or location on
    FriendsFort;
    ● (c) Your contact information, including name, address, telephone number,
    and email address;
    ● (d) A statement that you have a good faith belief that the use is not
    authorized by the copyright owner, its agent, or applicable law;
    ● (e) A statement, made under penalty of perjury, that the information in the
    notice is accurate and that you are the copyright owner or authorized to act
    on the owner’s behalf;
    ● (f) Your physical or electronic signature.

    Counter-Notice: If you believe your content was removed in error or as a result of
    misidentification, you may submit a counter-notice to the Designated Agent.
    Counter-notices must comply with the requirements of 17 U.S.C. § 512(g).
    FriendsFort will restore the content within 10–14 business days unless the
    claimant notifies FriendsFort of legal action against you.

    Three-Strike DMCA Policy — Permanent Account Termination
    Users who receive three (3) or more valid DMCA takedown notices will
    have their accounts permanently and irrevocably terminated. There are no
    exceptions to this policy. FriendsFort is required by law to implement and
    enforce a repeat infringer policy to maintain DMCA safe harbor protections.
    5.6 Trademarks
    Users may not use FriendsFort’s name, logo, brand marks, or any confusingly
    similar designation in any manner that implies endorsement, official partnership,
    or affiliation with FriendsFort without prior written consent from FriendsFort, Inc.
    Users also may not post content that infringes upon any other party’s registered
    trademark or service mark.
  24. Prohibited Content and Conduct
    6.1 Zero-Tolerance Offenses — Immediate Permanent Termination
    and Law Enforcement Referral

    The conduct listed in this section results in IMMEDIATE AND PERMANENT
    violations.

    and relevant law enforcement agencies under 18 U.S.C. § 2258A.
    ● Child Exploitation and Grooming: Soliciting, luring, grooming, or
    otherwise targeting minors for sexual purposes; sharing personal
    information of minors for predatory or exploitative purposes.
    ● Terrorism and Violent Extremism: Posting, sharing, or promoting content
    that incites, plans, recruits for, facilitates, or glorifies acts of terrorism,
    genocide, or mass violence; distributing propaganda from designated
    terrorist organizations.
    ● Credible Threats of Violence: Explicit, credible threats of violence or
    death against specific individuals, groups, or public figures; sharing plans,
    instructions, or intent relating to mass casualty events.
    ● Human Trafficking: Recruiting, advertising, facilitating, or promoting
    human trafficking, forced labor, forced marriage, or any form of modern
    slavery.
    ● Non-Consensual Intimate Imagery (NCII): Posting or distributing
    intimate, sexual, or nude images or videos of any individual without their
    explicit consent — commonly referred to as “revenge porn.” This conduct is
    a criminal offense in most U.S. states and many countries worldwide.
    ● Cyberstalking and Criminal Harassment: Sustained targeted harassment
    campaigns, doxxing (the publication of private identifying information such
    as home addresses or financial details), or coordinated conduct designed to
    cause a person to fear for their personal safety.
    ● Hacking and Malware Distribution: Sharing malicious code, ransomware,
    phishing links, exploit kits, or unauthorized access tools targeting other
    users, the Platform, or third-party systems.
    6.2 Prohibited Content — Account Suspension and Possible Law
    Enforcement Referral
    The following conduct may result in content removal, temporary or permanent
    account suspension, and potential referral to law enforcement authorities,
    depending on the severity and context of the violation:
    ● Hate Speech: Content that dehumanizes, demeans, or calls for
    discrimination against individuals or groups based on race, ethnicity,
    national origin, religion, gender, gender identity, sexual orientation,
    disability, or immigration status;
    ● Graphic Violence: Excessively graphic, gratuitous, or exploitative
    depictions of violence, gore, or torture not presented in a clearly
    newsworthy, documentary, or educational context;
    ● Suicide and Self-Harm Promotion: Content that glorifies, encourages, or
    provides detailed instructions for suicide or self-harm. Safe messaging
    guidelines from recognized mental health organizations apply to all such
    content;
    ● Misinformation and Disinformation: Deliberately false health
    information (including medical misinformation), fabricated news designed to
    cause public harm, and election interference content;
    ● Impersonation: Creating accounts or profiles designed to deceive others by
    impersonating real individuals, brands, organizations, or public figures;
    ● Explicit Sexual Content: Explicit sexual content involving adults is
    prohibited on standard accounts unless the user holds a verified Adult
    Content Creator account subject to additional terms and mandatory age
    gating;
    ● Drug Trafficking: Buying, selling, facilitating, or advertising illegal drugs,
    controlled substances, or prescription medications without a valid license;
    ● Illegal Weapons: Selling, trading, or providing instructions for illegal
    firearm modifications (including auto-sears and ghost guns) or engaging in
    unlicensed weapons trafficking;
    ● Fraud and Scams: Phishing attacks, advance-fee fraud schemes, fake
    giveaways, pyramid schemes, or any other deceptive financial schemes
    targeting users;
    ● Privacy Violations: Posting personal information of other individuals —
    including home addresses, phone numbers, financial details, or government
    identification numbers — without their explicit consent;
    ● Animal Cruelty: Content depicting the intentional abuse, torture, or killing
    of animals for entertainment or any non-educational purpose.
    6.3 Content Requiring Age-Restriction Labels
    Users must apply appropriate age-restriction labels to any content containing the
    following, prior to posting:
    ● Mature themes or strong language not suitable for users under the age of
    18;
    ● Depictions of alcohol or tobacco use;
    ● Mild violence in a gaming or entertainment context;
    ● Adult humor or mature themes that may not be appropriate for younger
    audiences.
    Failure to appropriately label age-restricted content constitutes a violation of these
    Terms and may result in enforcement action under Section 7.
  25. Account Suspension, Termination, and Enforcement
    7.1 Graduated Enforcement Framework
    FriendsFort employs a graduated enforcement system calibrated to the nature,
    severity, and frequency of violations. The four enforcement levels are as follows:

    7.2 Mandatory Reporting to Authorities
    Law Enforcement Reporting — Without Prior Notice to the User ⚠
    FriendsFort will report to law enforcement authorities without prior notice
    to the account holder in the circumstances described below.
    FriendsFort will proactively report to law enforcement authorities when:
    ● Child sexual exploitation material (CSAM) is detected or reported
    (mandatory reporting under federal law, 18 U.S.C. § 2258A);
    ● A credible, imminent threat to the life or safety of any person is identified;
    ● Evidence of terrorist activity, planning, or recruitment is discovered;
    ● Evidence of human trafficking is found;
    ● A valid legal demand — including a court order, subpoena, or official law
    enforcement request — is received; or
    ● FriendsFort reasonably believes that reporting is necessary to prevent
    serious physical harm to any individual.
    7.3 User Reporting Tools
    Every post, video, comment, direct message, and user profile on FriendsFort
    includes an accessible “Report” function. Reports are reviewed by FriendsFort’s
    Trust & Safety team within 24 to 72 hours. Reports involving imminent physical
    danger or active harm are escalated as urgent matters and will be reviewed within
    1 hour to the extent reasonably practicable. For emergency safety matters, users
    may contact safety@friendsfort.com directly. Users who submit false,
    misleading, or bad-faith reports may face account action for abuse of the reporting
    system.
    7.4 Appeals Process
    Users subject to Level 1, 2, or 3 enforcement actions may appeal within 30 days of
    the action via:
    ● Email: appeals@friendsfort.com (include your account username and the
    date of the enforcement action); or
    ● The in-app Appeals Center accessible through your account settings.
    FriendsFort will review and respond to appeals within 14 business days. Appeal
    decisions regarding account-level actions are final. FriendsFort is not obligated to
    disclose specific details about its enforcement methodology or the identity of
    reporting parties. Zero-tolerance violations (Level 4) are not subject to appeal.
  26. Live Streaming Rules
    FriendsFort’s live streaming feature is subject to all provisions of these Terms,
    with the following additional requirements:
    ● Users must be at least 18 years of age to independently initiate a live
    stream. Users aged 13–17 may live stream only with demonstrated verifiable
    parental or guardian consent;
    ● No copyrighted music, commercially released audio, films, or television
    broadcasts may be played, performed, or streamed without holding the
    appropriate valid license;
    ● Nudity, explicit sexual content, and graphic violence are strictly prohibited
    during any live stream;
    ● Live streams are subject to real-time moderation and may be terminated
    immediately and without prior warning for violations of these Terms;
    ● FriendsFort may archive live stream recordings for up to 90 days for
    moderation review, safety investigation, and legal compliance purposes;
    ● Any illegal activity conducted or depicted during a live stream — including
    but not limited to drug use, assault, or the commission of any criminal
    offense — will result in immediate stream termination, permanent account
    ban, and mandatory notification to law enforcement authorities.
  27. Advertising and Commercial Content
    9.1 FriendsFort Advertising
    FriendsFort may display advertisements and promotional content on the Platform
    based on user interests, demographics, and activity. Users may not interfere with,
    block, or misrepresent paid advertising content displayed on the Platform. All
    advertising on FriendsFort is governed by the separate FriendsFort Advertising
    Policy, which is incorporated into these Terms by reference.
    9.2 Creator Monetization and Sponsored Content
    Eligible creators may participate in FriendsFort’s Creator Monetization
    Program subject to the separate Creator Terms and eligibility requirements. Any
    content that is sponsored, paid for, gifted, or otherwise supported by commercial
    partnerships must be clearly and conspicuously disclosed using the labels #Ad,

Sponsored, or #Paid, in accordance with the U.S. Federal Trade Commission

(FTC) Endorsement Guidelines (16 CFR Part 255). Failure to disclose material
commercial relationships is a violation of both these Terms and applicable FTC
regulations and may expose the creator to independent regulatory liability.
9.3 Prohibited Advertising Conduct
The following advertising-related conduct is strictly prohibited on FriendsFort:
● Running fraudulent advertisements, misleading promotions, or fake
giveaways;
● Advertising illegal products, services, or substances;
● Promoting multi-level marketing (MLM) schemes, pyramid schemes, or
other predatory financial structures;
● Misrepresenting affiliation with, or endorsement by, FriendsFort or any
third party.

  1. Intellectual Property — FriendsFort Platform
    The FriendsFort name, wordmark, logo, platform design and interface, software
    code, algorithms, data models, and all original content created by or exclusively for
    FriendsFort are protected by applicable U.S. and international copyright,
    trademark, patent, and trade secret law.
    Subject to your compliance with these Terms, FriendsFort grants you a limited,
    non-exclusive, non-transferable, revocable license to access and use the
    Platform for lawful personal, non-commercial purposes only. This license expressly
    does not include the right to:
    ● Reproduce, copy, or redistribute any part of the Platform or its content;
    ● Modify, adapt, or create derivative works based on the Platform’s software,
    design, or proprietary materials;
    ● Reverse-engineer, decompile, or disassemble the Platform’s software or
    code;
    ● Use FriendsFort’s name, logo, or brand materials for any commercial
    purpose without prior written authorization.
    All rights not expressly granted to you by these Terms are reserved exclusively by
    FriendsFort, Inc.
  2. Third-Party Services and Links
    The Platform may integrate with, link to, or otherwise make available third-party
    services, applications, websites, and platforms. FriendsFort does not control,
    operate, endorse, or take any responsibility for the content, availability, accuracy,
    security practices, or privacy practices of any third-party service. Your use of any
    third-party service is at your own risk and is subject to the applicable third-party
    terms of service and privacy policies, which you should review independently
    before use.
    Third-party developers who access the Platform via FriendsFort’s API are subject
    to the FriendsFort Developer Agreement and applicable API rate limits.
    FriendsFort is not liable for any harm arising from unauthorized or non-compliant
    use of its API by third parties.
  3. Disclaimers and Limitation of Liability
    12.1 Service Disclaimer
    THE FRIENDSFORT PLATFORM IS PROVIDED ON AN “AS IS” AND “AS
    AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR
    IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF
    MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON
    INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION.
    FriendsFort does not warrant that:
    ● The Platform will be continuously available, uninterrupted, timely, or error
    free;
    ● The Platform is free from viruses, malware, or other harmful components;
    ● Any defects or errors in the Platform will be corrected; or
    ● User-generated content is accurate, complete, reliable, or lawful.
    12.2 Limitation of Liability
    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FRIENDSFORT,
    INC., ITS DIRECTORS, OFFICERS, EMPLOYEES, PARTNERS, LICENSORS, AND
    AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL,
    CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND,
    INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE
    LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR
    USE OF (OR INABILITY TO ACCESS OR USE) THE PLATFORM, EVEN IF
    FRIENDSFORT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
    FriendsFort’s total aggregate liability to you for any and all claims arising from or
    relating to these Terms or your use of the Platform shall not exceed the greater of:
    (a) one hundred U.S. dollars (USD $100.00); or (b) the total amount paid by
    you to FriendsFort in the twelve (12) months immediately preceding the
    event giving rise to the claim.
    Nothing in these Terms shall exclude or limit FriendsFort’s liability for: (i) death or
    personal injury caused by FriendsFort’s proven negligence; (ii) fraud or fraudulent
    misrepresentation; or (iii) any other liability that cannot be excluded or limited by
    applicable law.
  4. Indemnification
    You agree to defend, indemnify, and hold harmless FriendsFort, Inc. and its
    officers, directors, employees, shareholders, partners, agents, and successors from
    and against any and all claims, actions, demands, liabilities, damages, losses,
    settlements, judgments, costs, and expenses (including reasonable attorneys’ fees
    and legal costs) arising out of or relating to:
    ● Your violation of any provision of these Terms and Conditions;
    ● Any content you post, share, upload, or transmit on or through the Platform;
    ● Your violation of any third-party rights, including but not limited to
    copyright, trademark, privacy rights, and rights of publicity;
    ● Your violation of any applicable law, regulation, or governmental order; or
    ● Your use or misuse of the Platform or any FriendsFort service or feature.
    FriendsFort reserves the right, at its own expense, to assume the exclusive defense
    and control of any matter otherwise subject to indemnification by you, in which
    case you agree to cooperate fully with FriendsFort’s defense of such matter.
  5. Governing Law and Dispute Resolution
    14.1 Governing Law
    These Terms and Conditions, and any dispute or claim arising out of or in
    connection with them or their subject matter or formation (including non
    contractual disputes or claims), shall be governed by and construed in accordance
    with the laws of the State of Delaware, United States of America, without
    regard to its conflict of law principles or provisions. For users in the EU or EEA,
    mandatory local consumer protection laws shall apply and cannot be contractually
    waived.
    14.2 Informal Resolution — Required First Step
    Before initiating any formal arbitration or litigation, you agree to first attempt to
    resolve the dispute informally by contacting FriendsFort at
    legal@friendsfort.com with a written description of the nature of the dispute,
    your requested remedy, and your contact information. FriendsFort will use
    commercially reasonable efforts to resolve the dispute within 60 days of receipt of
    such notice. If the dispute is not resolved within that period, either party may
    proceed to formal dispute resolution as described below.
    14.3 Binding Arbitration (U.S. Users)
    For users located in the United States, any dispute, claim, or controversy arising
    out of or relating to these Terms or the Platform that cannot be resolved informally
    shall be resolved by binding individual arbitration administered by the
    American Arbitration Association (AAA) under its Commercial Arbitration
    Rules. The arbitration shall be conducted in English. The arbitrator’s decision shall
    be final and binding.
    Class Action Waiver
    YOU AND FRIENDSFORT EACH WAIVE ANY RIGHT TO PARTICIPATE IN A
    individually.
    CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION TO THE FULLEST
    EXTENT PERMITTED BY APPLICABLE LAW. All disputes must be brought
    Arbitration Opt-Out: You have the right to opt out of binding arbitration within
    30 days of the effective date of these Terms (June 2, 2026) by sending an email to
    legal@friendsfort.com with the subject line “Arbitration Opt-Out” and your full
    name and account information. Opting out does not affect any other provision of
    these Terms.
    14.4 EU and UK Users
    Users located in the European Union or United Kingdom may bring claims before
    the courts of their country of residence and are entitled to contact the relevant
    national consumer protection authority or ombudsman body in their jurisdiction.
    Nothing in these Terms restricts EU or UK users’ rights under applicable
    mandatory consumer protection legislation.
  6. Changes to These Terms
    FriendsFort reserves the right to modify, update, or replace these Terms at any
    time at its sole discretion. For material changes — those that significantly alter
    your rights or obligations — FriendsFort will provide notice via:
    ● An email notification to your registered email address; and
    ● A prominent in-app notification within the Platform.
    Such notice will be provided at least 30 days before the revised Terms take effect.
    Minor, non-material changes — such as typographical corrections, grammatical
    improvements, or formatting updates — may be made without advance notice. The
    “Effective Date” and “Version” displayed at the top of this document will reflect the
    most current version at all times.
    Your continued access to or use of the Platform after the revised Terms’ effective
    date constitutes your acceptance of the updated Terms. If you do not agree to the
    revised Terms, you must stop using the Platform and delete your account before
    the new effective date.
  7. Termination by User
    You may terminate your FriendsFort account at any time by navigating to Settings

Account > Delete Account within the Platform and following the on-screen
instructions. Upon account deletion:
● Your publicly visible profile and content will be removed from the Platform
within 30 days of the deletion request;
● Direct messages and content you have sent to other users may remain
visible to the recipients of those messages, as FriendsFort does not control
the viewing of delivered messages;
● Some personal data will be retained by FriendsFort as required by
applicable law, for the resolution of disputes, enforcement of these Terms,
or for legitimate safety and legal compliance purposes, as described in the
Privacy Policy.
Premium Subscriptions: If you hold an active premium subscription, you must
cancel it separately through your subscription settings prior to initiating account
deletion. Account deletion does not automatically cancel active paid subscriptions,
and FriendsFort will not be liable for charges incurred due to failure to cancel
prior to deletion.

    Provision Description
    Entire Agreement These Terms, the FriendsFort Privacy
    Policy, and all applicable supplemental
    policies referenced herein constitute the
    entire agreement between FriendsFort,
    Inc. and the user with respect to the
    subject matter hereof and supersede all
    prior or contemporaneous agreements,
    understandings, and representations.
    Severability If any provision of these Terms is held to
    be invalid, illegal, or unenforceable by a
    court of competent jurisdiction, that
    provision shall be modified to the
    minimum extent necessary to make it
    enforceable, or severed if modification is
    not possible, and the remaining provisions
    shall continue in full force and effect.
    Waiver FriendsFort’s failure or delay in exercising
    any right, remedy, power, or privilege
    under these Terms shall not operate as a
    waiver thereof, nor shall any single or
    partial exercise of any right preclude any
    further exercise of the same or other
    rights.
    Provision Description
    Assignment FriendsFort may assign, transfer, or
    delegate any of its rights and obligations
    under these Terms without notice to you.
    You may not assign or transfer your rights
    or obligations under these Terms without
    the prior written consent of FriendsFort,
    Inc.
    Force Majeure FriendsFort shall not be liable for any
    failure or delay in performance caused by
    circumstances beyond its reasonable
    control, including natural disasters, acts of
    government, power failures, internet
    outages, cyberattacks, or other events of
    force majeure.
    No Third-Party Beneficiaries These Terms do not and are not intended
    to confer any rights or remedies upon any
    person or entity other than you and
    FriendsFort, Inc.
    Language These Terms are drafted in English. Any
    translations provided are for convenience
    only. In the event of any inconsistency or
    conflict, the English-language version
    shall prevail.
